General Terms and Conditions (GTC)

1. Validity and Scope

1.1 These General Terms and Conditions (hereinafter "GTC") shall apply exclusively to all current and future business relationships, legal transactions, and service provisions between Express Jobs (hereinafter referred to as "Service Provider") and its Customers. The Service Provider provides its services exclusively on the basis of these GTC. These terms and conditions are specifically designed to govern the legal relationship between the Service Provider and private consumers (B2C) and shall be deemed agreed upon for the entire duration of the business relationship, even if they are not expressly referred to in individual subsequent cases.

1.2 By placing an order via the website, the online store, by email, or through any other electronic or verbal communication channel, the Customer expressly acknowledges and agrees to the exclusive validity of these GTC. Any conflicting, deviating, or supplementary terms and conditions provided by the Customer are hereby expressly rejected and shall not become part of the contract, even if the Service Provider is aware of them, unless their validity is expressly confirmed in writing by the Service Provider.

1.3 The version of the GTC valid at the time of the conclusion of the contract shall be decisive. The Service Provider reserves the right to amend these GTC at any time. Any such amendments will be communicated to the Customer and shall be deemed accepted unless the Customer objects in writing within a period of 14 days following the notification.

2. Conclusion of Contract

2.1 The presentation and description of services on the website of Express Jobs do not constitute a legally binding offer on the part of the Service Provider, but rather a non-binding invitation for the Customer to submit an offer to enter into a service agreement (invitatio ad offerendum).

2.2 A legally binding contract between the Service Provider and the Customer is established at the moment the Customer places an order (the offer) and the Service Provider subsequently issues a formal order confirmation via email (the acceptance). Unless otherwise explicitly agreed upon in writing, the contract is deemed effective upon the dispatch of this electronic confirmation.

2.3 The Service Provider expressly reserves the right, at its sole and absolute discretion, to refuse any order or to decline the conclusion of a contract without providing specific reasons. No legal claim to the conclusion of a contract exists for the Customer prior to the formal confirmation by the Service Provider.

2.4 The scope of the contractual relationship is strictly limited to the specific services and items explicitly listed and described in the order confirmation or the corresponding invoice, provided that the required payment has been successfully processed.

3. Prices, Payment Terms and Due Date

3.1 All prices and fees indicated on the Service Provider’s website or in the online store are gross prices and include the applicable statutory value-added tax (VAT) as required by law. The prices valid at the time of the order shall apply.

3.2 All invoices and contractual amounts are due for payment immediately and in full upon the conclusion of the contract, unless a different payment term has been expressly agreed upon in writing between the Service Provider and the Customer.

3.3 The Service Provider operates on a strict "payment-in-advance" basis. The Customer acknowledges and agrees that the Service Provider’s obligation to perform any part of the commissioned service (including, but not limited to, the preparation, processing, or dispatch of documents) shall only commence after the full and final receipt of the agreed payment.

3.4 Any delays in the commencement of the services resulting from a delay in payment by the Customer shall be the sole responsibility of the Customer and shall not affect the agreed processing times or deadlines. The Service Provider reserves the right to suspend any ongoing or future services for as long as any outstanding amounts from the current or previous contractual relationships remain unpaid.

4. Customer Obligations and Provision of Documentation

4.1 The successful provision of the services by Express Jobs is fundamentally dependent on the active cooperation and timely delivery of information by the Customer. The Customer is strictly obligated to provide a complete, up-to-date Curriculum Vitae (CV) and all further necessary documentation required for the application process in a timely manner. Any delays in the provision of these documents shall result in a corresponding extension of the service delivery period for which the Service Provider shall not be held liable.

4.2 The Customer expressly warrants and represents that all information, personal data, and professional history provided to the Service Provider are truthful, accurate, and not misleading. The Service Provider is under no legal obligation to verify the accuracy or authenticity of the information provided by the Customer and shall rely entirely on the data as submitted.

4.3 Furthermore, the Customer warrants that they hold all necessary copyrights, usage rights, and legal permissions for any and all materials uploaded or sent to the Service Provider (including, but not limited to, profile photographs, certificates, and reference letters). The Customer shall indemnify and hold the Service Provider harmless against any and all third-party claims arising from a breach of these intellectual property rights or the provision of false information.

4.4 If the Customer fails to provide the required documents after a reasonable request by the Service Provider, this shall be deemed a breach of the duty to cooperate. In such a case, the Service Provider reserves the right to conclude the service based on the available information or to terminate the contract, whereby any payments already made shall not be refunded.

4.5 By placing an order, the Customer grants Express Jobs the explicit right and authorization to forward their application documents, personal contact details, and any professional information provided to potential employers and third-party companies within the scope of the agreed service.

4.6 The Customer further grants the Service Provider the right to edit, modify, supplement, or omit parts of the provided application materials (e.g., CV formatting, text optimization, or layout adjustments) as deemed necessary by the Service Provider to enhance the quality or suit the requirements of the specific application process.

5. Service Execution, Refunds, Guarantee & Liability

5.1 The Customer acknowledges that the services are highly personalized. Therefore, the statutory 14-day right of withdrawal expires once the service performance has commenced.

5.2 Express Jobs operates as a document delivery service. Success (e.g., job offers or interviews) depends on external market factors and third-party decisions (e.g., employers, visa authorities) beyond the Service Provider's control. Consequently, no specific number of responses or successful outcomes are guaranteed, and no liability is accepted for the results of these external processes.

5.3 Any "Guarantee" is strictly conditional and only valid if the Customer provides verifiable proof of German Language Level B1 or higher, OR previous legal work experience in Germany or Austria at the time of purchase. If these criteria are not met, any advertised guarantee is void and no refunds will be issued.

5.4 The Customer bears sole responsibility for the accuracy and legal compliance of all provided documents. Liability for damages caused by minor negligence is expressly excluded. Except in cases of intent or gross negligence, any liability is limited to the amount typically foreseeable at the time of the contract conclusion.

6. Duration and Processing

6.1 Express Jobs generally completes the commissioned application dispatch within a period of 3 weeks. This processing period begins only after the Service Provider has received all necessary documents and information from the Customer in full.

6.2 The Service Provider’s obligation is limited to the professional dispatch of documents. The Customer acknowledges that the Service Provider has no influence over the internal processes, decision-making periods, or response times of the contacted companies or third-party employers.

6.3 Any stated deadlines are estimated timeframes for the execution of the service and do not constitute a guarantee of a specific response date from potential employers.

7. Force Majeure

7.1 In the event that the Service Provider is prevented from fulfilling its contractual obligations due to circumstances beyond its control (Force Majeure), the Service Provider shall be temporarily released from its duties for the duration of the hindrance.

7.2 Force Majeure includes, but is not limited to, official governmental interventions, severe weather, natural disasters, failure of telecommunications or IT systems, illness, or unforeseen loss of personnel. No liability for delays resulting from such events shall be accepted.

8. Miscellaneous and Service Nature

8.1 These GTC and all contractual relationships between the parties are governed exclusively by the laws of the Republic of Austria. The sole contractual and communication language is English.

8.2 Express Jobs operates strictly as a technical and administrative document delivery service. It is explicitly understood that the services provided do not constitute labor leasing, personnel placement, or recruitment agency activities. Express Jobs does not act as an intermediary in employment negotiations, and no mediation or placement fees are charged for the successful conclusion of employment contracts.

8.3 Should any individual provision of these GTC be found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that most closely reflects the original economic and legal intent.

9. Jurisdiction

9.1 All disputes arising from or in connection with these GTC, including questions regarding their existence or validity, shall be subject to the exclusive jurisdiction of the competent court at the registered office of the Service Provider.

9.2 For Consumers (B2C), this jurisdiction clause applies only to the extent that it does not restrict any mandatory legal provisions of the state in which the Customer has their habitual residence or domicile.
